This Website is owned and operated by Hong Kong Gemstone Manufacturers’ Association Limited (“HKGMA”). HKGMA respect personal data and is committed to full implementation and compliance with the data protection principles and all relevant provisions in the Personal Data (Privacy) Ordinance (Cap. 486) ("the Ordinance").This Statement is applicable to the users and visitors of this Website and any other persons that their personal data is collected, used and held by us. In this Statement, "HKGMA" and “We” shall mean Hong Kong Gemstone Manufacturers' Association Limited.

HKGMA respects the users’ privacy and limits the personal data collected to the minimum required to provide a better service.This Statement intends to notify you what kind of personal data is collected, why your personal data is collected, how it will be used, to whom the personal data will be transferred and to whom data access requests are to be addressed.

  1. Kinds of Personal Data Collected, Used and Held

1.1 We will only collect, use and hold your name, your company name, company address, email address, fax and telephone number and/or any other information as required in provision services to users.

2.1 From time to time, we may collect your personal data for the purposes set out in this Statement and we aim to use and hold such personal data on the basis of the guidelines and principles set out in this Statement and the Ordinance.

2.2 You may provide us with your personal data at your own will. We will indicate in the relevant forms or applications if the required personal data is mandatory. If you fail to provide the mandatory personal data to us, we will not provide to you the information, materials, service and/or products of HKGMA which you are applying for.

3.1 Your personal data held by us will be used for the following purposes:

  • keeping you informed of the latest developments about HKGMA and news, trainings activities, goods, services, facilities and/or events organized or provided by HKGMA and/or other related organizations;
  • processing your complaints, enquiries and/or feedbacks;
  • conducting internal statistical research and analysis; and
  • other purposes directly relating to any of the above.

4.1 Personal data held by HKGMA will be kept confidential. However,HKGMA may, where such disclosure and/or transfer is necessary to satisfy the purposes, or directly related purposes, for which the personal data was collected, provide such information and/or copies to the following parties (whether within or outside the HKSAR):

  • any personnel, agent, adviser, auditor, contractor, service provider and/or third party who provides services and/or advice to us in connection with our operations insofar as required to enable us to provide, or assist us in providing, the services;
  • government bodies and other regulators as required under the law or pursuant to any regulatory arrangements between HKGMA and the relevant governmental bodies or regulators; and/or
  • any person to whom we are under an obligation under law to make disclosure.

4.2 Personal data may also be disclosed to any person or persons pursuant to any statutory requirements or any court orders. In addition, personal data may be disclosed under any of the circumstances described in part VIII of the Ordinance in which the concerned personal data are exempt from the provisions of data protection principle 3 of the Ordinance.

4.3 Except as stated above or with your prior consent, HKGMA will not transfer or disclose your personal information to any third party.

5.1 Your personal data will be kept in the office of HKGMA or by the service providers engaged by HKGMA and are accessible only to our authorized employees and service providers.

5.2 We strive at all times to ensure that your personal data will be protected against unauthorized and/or accidental access, processing, erasure and/or other use. We have implemented appropriate physical, electronic and managerial measures to safeguard and secure your personal data.

6.1 We only retain personal data for so long as it is necessaryfor the fulfilment of the purpose(s) for which they were collected and of relevant legal requirements.If you desire to erase your personal data from our electronic databases, please contact us.

7.1       Use of cookies:

7.1.1        When you browse this Website, cookies will be stored in your computer's hard drive. 7.2       Statistics on visitors to our Website:

7.2.1        Our servers may automatically collect data about your Internet address when you visit our Website. 7.2.2        We use the webserver access log for the purpose of maintaining and improving our Website such as to determine the optimal screen resolution, most frequently visitedpages etc. We use such data only for website enhancement and optimization purposes.

7.2.3        We do not use, and have no intention to use the visitor data to personally identify any individual.

9.4   In general circumstances, your requests or enquiries will be handled within 30working days after receipt of the same and verification of your identity.

10.1 This Statement is governed by and shall be construed in all respects in accordance with the laws of HKSAR and all the parties hereto hereby submit to the exclusive jurisdiction of the HKSAR courts in connection with any matters arising hereunder.

11.1 If there are any discrepancies between the Chinese version of this Statement” and its English version, the English version shall prevail. If any part of the Chinese version is unclear, reference should be made to the English version. The Chinese version may not be translated into English for the purpose of comparing with or interpreting the English version.

  1. EFFECTIVE DATE

12.1 This Statement becomes effective from 1st March, 2016.
